1. Agreement and seller information
These Terms govern MS Reach purchases made through malleablesoft.in and use of MS Reach for Windows supplied by Malleable Software Private Limited, CIN U93000PN2021PTC198819, with its registered and operating office at Flat No. 302, Korgaonkar Park, Saraswati Nagar, Gadhinglaj, Maharashtra 416502, India.
By accessing the website, ordering, downloading, activating or using MS Reach, you agree to these Terms. If acting for an organisation, you confirm authority to bind it. You must be at least 18 years old.
2. Product and intended use
MS Reach is downloadable Windows desktop software for lawful business messaging and automation. It is offered as a fixed-term prepaid licence in 6-month, 1-year and 2-year terms. Licences are prepaid for a fixed term and do not renew automatically.
Supported systems are Windows 10 and Windows 11. MS Reach supports 64-bit editions of Windows 10 and Windows 11 and requires a stable internet connection, sufficient storage and memory, current Windows security updates and access to applicable third-party services.
3. Orders, prices, taxes and payment
The price, currency, licence term, device count, included services and applicable taxes shown at checkout form part of the order. Prices, currency, applicable taxes and available payment methods are displayed at checkout before an order is placed.
Failed orders are not activated. Verified duplicate successful charges will be refunded to the original payment method. Contact billing@msreach.in with both transaction references.
4. Digital delivery and licence
After successful payment, the installer and purchase code are provided through the confirmation page, customer account and/or email. Unless the order page states otherwise, installer download access is available for seven days or five downloads. Support may restore installer access after order verification where appropriate; this does not restore or regenerate a completed licence.
A purchase grants a limited licence, not ownership. Each paid purchase code permits one licence generation for one Windows device. Generation is final: the machine code cannot be changed and a generated licence cannot be recovered, transferred or regenerated. A different device requires a new purchase.
5. Acceptable use and customer responsibility
You are responsible for recipients, lists, content, timing, frequency, consent, opt-outs and compliance with privacy, marketing, consumer, telecommunications and intellectual-property laws, Platform Terms and applicable DND/telemarketing requirements.
You must not use MS Reach for spam, purchased or scraped lists, phishing, fraud, harassment, malware, impersonation, illegal content, unauthorised extraction, number enumeration, rate-limit or security circumvention, ban evasion, or misleading claims of WhatsApp/Meta approval. The Acceptable Use Policy is incorporated into these Terms.
6. Independent product and third parties
MS Reach is an independent product of Malleable Software. It is not affiliated with, sponsored by, endorsed by, certified by or approved by WhatsApp or Meta. Third-party services operate under their own terms and may change, restrict or discontinue access.
We do not control message delivery, account review, bans, appeals, platform availability or third-party service decisions.
7. Updates and support
Maintenance and minor updates are included during the paid licence term. Major upgrades, new editions and third-party charges may require separate purchase.
Support is available through support@msreach.in and +91 94224 19969, Monday-Saturday, 09:30-18:30 IST, excluding public holidays, with an initial response target of two business days.
8. Suspension and termination
We may investigate credible abuse reports and suspend or terminate website access, licences, activation, updates or support for non-payment, material breach, fraud, security risk, unlawful activity, platform abuse or legal requirement. No advance notice is required where it would create risk or be unlawful.
9. Intellectual property
The website, software, documentation, designs, content and Company marks are owned by or licensed to Malleable Software. You may not copy, resell, sublicense, rent, reverse engineer, bypass licence controls, create derivative products, scrape the website, remove notices or test security without written permission, except where applicable law prevents restriction.
10. Privacy
The MS Reach Privacy Policy explains how personal data is handled. Customers remain independently responsible for recipient data and communications under their control.
11. Warranties and disclaimers
To the maximum extent permitted by law, the website and software are provided “as is” and “as available”. We do not guarantee uninterrupted operation, compatibility with every environment, message delivery, campaign outcomes, revenue, platform approval or avoidance of account restrictions. Non-excludable statutory rights remain unaffected.
12. Liability and indemnity
Subject to liability that cannot legally be limited, aggregate Company liability will not exceed fees paid for the affected MS Reach licence during the 12 months before the event. We are not liable for indirect, incidental, punitive or consequential losses, including lost revenue, reputation, data, messages, numbers or platform accounts.
To the maximum extent permitted by law, you will indemnify the Company against claims, penalties and reasonable costs arising from your lists, recipients, messages, content, consent failures, spam, scraping, fraud, infringement, breach of law or Platform Terms, or use by persons accessing your licence.
13. Refunds
Refunds are governed by the Refund Policy. Nothing limits a remedy or consumer right that cannot lawfully be excluded.
14. Governing law and disputes
These Terms are governed by the laws of India and Maharashtra. Parties will first attempt good-faith written resolution for 30 days. Subject to non-waivable rights, unresolved disputes will be referred to one arbitrator, in English, seated and held in Pune, Maharashtra, under the Arbitration and Conciliation Act, 1996. Courts in Pune will have jurisdiction for interim relief, enforcement and non-arbitrable matters.
